Aquafeed Media, S.L.U. ("Aquafeed Media") owns and operates www.aquafeed.com and www.hatcheryfm.com and its publications ("the Websites") with address at Avda. Mahía 108 1G, 15220 Ames, Spain, email: info@aquafeed.com.

Aquafeed Media is responsible for aquafeed.com, a website focused on aquaculture feed news and hatcheryFM.com, a website focused on aquaculture hatchery news.

1. GENERAL TERMS OF USE

By accessing the Websites, any of the linked pages, or using any part of the Websites or any content or services on the Websites, the user agrees to be bound by these terms and conditions. If the user does not agree to all the terms and conditions, in their entirety, then may not access the Websites or use the content or any services on the Websites, and should cease your use of the Websites immediately.

These Terms & Conditions regulate the use of the Websites, which Aquafeed Media makes available to people who access it in order to provide them with information about their own services and/or third-party collaborator. The effective date of these Terms & Conditions of Use is January 1, 2022.

2. COPYRIGHT

The copyrights and all other (intellectual property rights) of the Websites, its source code, design, logos, navigation structures, the different elements and trading names contained therein are the exclusive property of Aquafeed Media who is entitled to exercise the rights to exploit them in any way and, in any case, the rights of reproduction, distribution, public communication and transformation, in accordance with the applicable Spanish and European Union legislation.

The total or partial reproduction of the contents of the Websites without the express written consent of Aquafeed Media is prohibited. The unauthorized use of these contents by any other person or company will give rise to legally established responsibilities.

Any type of exploitation is prohibited, including all types of reproduction, distribution, transfer to third parties, public communication and transformation, through any type of support and medium, of the aforementioned works, creations and distinctive signs without prior and express authorization of Aquafeed Media. Failure to comply with this prohibition may constitute an offense punishable by current legislation.

It is prohibited, except in cases expressly authorized by Aquafeed Media, to present the Websites or the information contained therein under frames, distinctive signs, trademarks or social or commercial names of another person, company or entity.

The infringement of any of the aforementioned rights may constitute a violation of these conditions, as well as a crime punishable in accordance with articles 270 et seq. of the Spanish Penal Code.

Aquafeed Media is not responsible for the use that users make of the Websites services, as well as any material on the Websites, which may infringe intellectual or industrial property rights or any other right of third parties.

3. ACCESS

Access to the Websites by users is free.

When the User signs up for publications or provides personal data to access any of the specific services (subscriptions), the Privacy Policy will be applied to personal data processing.

The contracting of products and services through the Websites by minors is prohibited.

Both access to the Websites owned by Aquafeed Media and the use that may be made of the information and content included therein will be the sole responsibility of the person who performs it. The conditions of access to the Websites will be subject to current legislation and the principles of good faith and lawful use by the user, being generally prohibited any type of action to the detriment of Aquafeed Media. The use of the Websites for illegal or unauthorized purposes shall be considered strictly prohibited.

4. LINKS

4.1 Links to other websites.
The user may find links to other web pages in the Websites through different buttons, links, banners, etc., which are managed by third parties. Aquafeed Media does not have the power or human or technical means to know, control or approve all the information, content, products or services provided by other websites to which links are established from the Websites. Consequently, Aquafeed Media cannot assume any type of responsibility for any aspect related to the web page to which a link is established from the Websites, specifically, as an example and not limited to, its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its content, in general.

The establishment of any type of link by the Websites to another external website does not imply that there is any kind of relationship, collaboration or dependency between Aquafeed Media and the person responsible for the external website.

4.2 Links to the Websites on other sites.
If any User, entity or website wishes to establish some type of link to the Websites, it must abide by the following stipulations.

The link may be directed to the home page or any other of those integrated on the Websites. The link must be complete, it must take the user, through a click, to the Websites' URL address or the URLs corresponding to the pages to link to.

In no case, unless Aquafeed Media expressly authorizes it, the website that links may reproduce, in any way, the Websites, include it as part of its website or within one of its "frames" or create a "browser" on any of the Websites pages.

Aquafeed Media does not authorize the establishment of a link to the Websites from those web pages that contain illicit, illegal, degrading, obscene materials, information or content, and in general, that contravene morality, public order or generally accepted social norms.

Aquafeed Media does not have the power or human and technical means to know, control or approve all the information, content, products or services provided by other websites that have established links to the Websites. Aquafeed Media does not assume any type of responsibility for any aspect related to the pages that establish that link to the Websites, specifically, on its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its contents, in general.

4.3 Services provided by third parties through the Websites.
Aquafeed Media does not guarantee the legality, reliability and usefulness of the services provided by third parties through these pages or on which Aquafeed Media only acts as an advertising channel.

Aquafeed Media will not be responsible for damages of any kind caused by the services provided by third parties through the Websites, and in particular, those caused by: failure to comply with the law, morals or public order; the incorporation of viruses or any other computer code, file or program that may damage, interrupt or impede the normal operation of any software, hardware or telecommunications equipment; the infringement of intellectual and industrial property rights, business secrets, contractual commitments of any kind; the performance of acts that constitute illicit, misleading or unfair advertising and, in general, that constitute unfair competition; the lack of veracity, accuracy, quality, relevance and/or timeliness of the content transmitted, disseminated, stored, received, obtained, made available or accessible; the infringement of the rights to honor, personal and family privacy and the image of people or, in general, any type of third party rights; the inadequacy for any kind of purpose and the disappointment of the expectations generated, or the vices and defects that could be generated in the third-party relationship; non-compliance, delay in compliance, defective compliance or termination for any reason of the obligations contracted by third parties and contracts made with third parties.

5. LIABILITY

Aquafeed Media does not guarantee the legality, reliability, usefulness, veracity or accuracy of the services or information provided through the Websites. Aquafeed Media cannot guarantee that all information on the Websites is complete and/or correct and is in no way liable for any direct or indirect damage, of whatever nature, arising from or in any way related to the use and/or the (temporary) unavailability of the Websites. Aquafeed Media is also not liable for the content that is placed by users or third parties, including advertisers, on the Websites or otherwise comes from third parties.

Consequently, Aquafeed Media does not guarantee nor is it responsible for the continuity of the contents of the Websites; the absence of errors in the content or the correction of any defect that may occur; the absence of viruses and/or other harmful components on the Websites or on the server that supplies it; the invulnerability of the Websites and/or the impregnability of the security measures adopted therein; the lack of usefulness or performance of the contents of the Websites; the damages caused, to itself or a third party, by any person who violates the conditions, rules and instructions that Aquafeed Media establishes in the Websites or through the violation of the security systems of the Websites.

However, Aquafeed Media declares that it has adopted all the necessary measures, within its possibilities and the state of technology, to guarantee the operation of the Websites and avoid the existence and transmission of viruses and other harmful components to users.

6. COMMUNICATIONS

If the user sends information of any kind to the Websites, the user declares, guarantees and accepts that has the right to do so freely, that said information does not infringe any intellectual property, trademark, patent, trade secret rights, or any other third party right, that such information is not confidential and that such information is not harmful to third parties.

The user acknowledges assuming responsibility and will hold Aquafeed Media harmless for any communication provided personally or on his behalf, the accuracy, legality, originality and ownership of the same reaching said responsibility without any restriction.

Acceptance of these general conditions implies the exclusive assignment by the user of any right to exploit intellectual or industrial property that the user may hold over the communications made through the Websites.

7. MODIFICATION OF THE TERMS OF USE

Aquafeed Media reserves the right to modify, at any time, the presentation and configuration of the Websites, as well as these Terms & Conditions of Use. Therefore, Aquafeed Media recommends that the user read them carefully each time they access the Websites.

8. DURATION AND MODIFICATION

The owner reserves the right to interrupt or cancel the Websites or any of the services in it, at any time and without prior notice, for technical reasons or of any other nature, being able to unilaterally modify both the conditions of access, as all or part of the contents therein, including all of this without prejudice to the rights acquired at that time.

9. APPLICABLE LAW AND COMPETENT COURT

For any questions that arise about the interpretation, application and compliance with these Terms & Conditions of Use, as well as the claims that may arise from its use, all the parties involved will be settled by Spanish Judges and Courts.
